AZƏRBAYCAN RESPUBLİKASININ HÜQUQ SISTEMİNDƏ KONSTİTUSİYA QANUNVERİCİLİYİ KONSTİTUSİYA HÜQUQUNUN MƏNBƏYİ KİMİ

Konstitusiya hüququnun mənbələri konstitusiya hüququ normalarının yaradılması, dəyişdirilməsi və ya ləğv edilməsi haqqında qanunvericilik orqanlarının qərarını təcəssüm etdirir. Konstitusiya hüququnun mənbəyinin yaradılması qanun yaradıcılığının tərkib hissəsidir, bunsuz konstitusiya hüququ normaları yarana bilməz. Konstitusiya hüququnun mənbələrindən danışarkən qeyd etmək lazımdır ki, bu siyahıya müxtəlif müəlliflərin demək olar ki, eyni mənbələri daxildir. Təbii ki, bəzi fərqlər var. Bu, ayrı-ayrı aktların konstitusiya hüququnun mənbəyi kimi tanınmasında bəzi çətinliklərlə bağlıdır. Bu çətinliklər mövcud hüquq sistemi, cəmiyyətin hüquqi şüuru və hüquq mədəniyyəti ilə bağlıdır. Konstitusiya hüququnun əsas mənbələri normativ hüquqi aktlar, məhkəmə presedentləri və adət hüququ, habelə bəzi hallarda beynəlxalq və ölkədaxili müqavilələrdir. Azərbaycan Respublikasının Konstitusiya hüququ çərçivəsində isə bu siyahıya normativ hüquqi aktlar daxildir.

Constitutional legislation in the legal system of the Republic of Azerbaijan
as a source of constitutional law

Abstract

Sources of constitutional law embody the decision of law-making bodies to create, change or repeal the norms of constitutional law. The creation of the source of constitutional law is an integral part of lawmaking, without which the norms of constitutional law can not arise.

Speaking of sources of constitutional law, it should be noted that this list includes almost the same sources by different authors. Of course, there are some differences. This is due to some difficulties in recognizing individual acts as sources of constitutional law. These difficulties are related to the existing legal system, the legal consciousness of the people and the legal culture. The main sources of constitutional law are normative legal acts, judicial precedents and customary law, as well as, in some cases, international and domestic treaties. Within the framework of the constitutional law of the Republic of Azerbaijan, this list includes normative legal acts.
